Privacy Policy

Overview
Forward Air Premier, Truckload Customers, Cartage Vendors and Truckload Carrier Load System (each, a “Forward Air Tracking System”) are each a set of applications specifically reserved for Forward Air’s best customers (“customers”) and certain Forward Air vendors (“vendors” and together with “customers”, “users” or “you”). The applications are only available through the Forward Air website www.forwardair.com. The set of applications contains information that is intended to assist customers and vendors quickly and easily obtain specific and accurate information on their shipments. A list of active and recovered shipments invoiced within ninety (90) days is provided along with attributes of the shipments such as status, estimated charges, pieces weight and status history. In order to provide this information efficiently, it is necessary to collect information to establish a secured account with the Forward Air Tracking System and collect information transmitted when the website is in use. This document identifies the specific information gathered and how that information is used.

General
Forward Air (“Forward Air”, “we”, “our” or “us”) values your privacy. As a Forward Air user, be assured that your privacy is protected. Any information gathered about our users is used internally to identify areas of improvement for the website. Information obtained directly from our users, through online forms and registrations is only used for the stated purpose.

What Information Forward Air Collects
We may collect one or more of the following categories of information about you when you visit our website or register for/use our applications or otherwise contact us including within the Forward Air Tracking System registration and the online forms provided on our website, including Credit Application, and the Investor Information Request Form. The specific types of information included in each of these categories are described in more detail here:

  • Category of Personal Information: Identifiers
  • Personal Information Collected: Name, address, phone and fax numbers, email address, account name, user ID
  • Source of Personal Information: Forward Air registration page (information collected directly from user), cookies.
  • Business Purpose for Collection of Personal Information: Identification, communications, security, improvement of our websites, legal, compliance and regulatory obligations.
  • Category of Personal Information: Sensitive Personal Information
  • Personal Information Collected: Social security number, driver’s license number, passport number
  • Source of Personal Information: Directly from you.
  • Business Purpose for Collection of Personal Information: Identification, communications, security, legal, compliance and regulatory obligations.
  • Category of Personal Information: Internet/Electronic Activity
  • Personal Information Collected: User status when logged in to the Forward Air Tracking System
  • Source of Personal Information: Your interactions with our websites, cookies.
  • Business Purpose for Collection of Personal Information: Improve our websites.
  • Category of Personal Information: Professional or Employment Related Information
  • Personal Information Collected: Company, Company Name
  • Source of Personal Information: Directly from you.
  • Business Purpose for Collection of Personal Information: Identification, communications, security, legal, compliance and regulatory obligations.

We do not collect the following categories of personal information: protected characteristics under California or federal laws, commercial information, biometric information, geolocation data, audio, electronic, visual, thermal, olfactory, or similar information, education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99), or other inferences drawn from the personal information we do collect.

What are "cookies" and how do we use them?

Cookies are small files that are stored by your browser on your computer's hard drive while accessing the Internet. Most companies like ours make use of browser cookies. Once you become user of a Forward Air Tracking System, we may use cookies occasionally to store some information on your computer, which will help the system perform faster as you use it. On occasion we will refresh the cookies as those parts of the system are modified or enhanced. Our cookies do not contain any personal information about you other than your user ID; they just enable us to provide a more efficient system by determining where we have performance issues relating to access of the web pages. The cookies will not enable third parties to access any of the information stored on your computer. Most web browsers are set to automatically accept cookies, but you can usually either change the browser preferences to warn when a cookie is about to be written, or to not accept them at all. Parts of the Forward Air website will function without the cookies but cookies are required in order to use the Forward Air Tracking System.

How Forward Air Uses the Information it Collects
We use the personal information that we collect about you as necessary for us:

  • To provide our website, including to establish a login to access the Forward Air Tracking System, and to be able to communicate with you when the need arises.
  • To monitor and manage our website, including to manage our business operations, to take steps to prevent, detect or investigate crime, fraud, misconduct or any unlawful action or omission.
  • To fulfill our legal and regulatory obligations and to meet the requirements of our own policies and procedures under applicable regulations.

How Forward Air Shares Personal Information

Forward Air is committed to protecting the personal information that our customers provide to us. We do not sell your personal information. The data you send to or enter into the Forward Air website is considered your confidential and proprietary information. It is our policy to respect the privacy of our customers and vendors, and for this reason we do not sell our customers or vendors data. We will not monitor, edit or disclose the contents of your data, other than to your customers, providers, etc. to whom you allow access, unless required to do so by law or in the good faith belief that such action is necessary. We may share your personal information with the following categories of recipients:

  • Service providers and contractors, including those who work to enhance our websites and those who protect the security of Forward Air systems.
  • Business partners and affiliates, including those with whom we work to provide our services.
  • Legal and regulatory authorities, including to respond to a subpoena or court order, judicial process, or regulatory inquiry, to defend against fraud, lawsuits, claims or other liabilities; and to prevent physical harm or financial loss in connection with any suspected or actual illegal activity.

How We Store and Secure Your Information

The security of all personal information provided to us is important and we take reasonable steps designed to protect your personal information. We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information that we receive against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure or use. We permit persons working for us to access and use your personal information only to serve our legitimate business purposes, in accordance with this Privacy Policy.

Retention of Personal Information
We will only retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, regulatory, accounting, or reporting requirements. If we ever collect any biometric information about you, we will not store that information for longer than three (3) years.

Your Rights & Choices 
Depending upon where you are located, certain choices and rights may be available to you under applicable data protection laws, including the right to request access to your personal information or to have your personal information deleted. If you have questions about what rights may apply to you, please contact us.

Non-Discrimination: You will not receive any discriminatory treatment by us for the exercise of your privacy rights conferred by these laws.

Verifying Your Request: Only you, or a person that you authorize to act on your behalf, may make a request related to your personal information. In the case of access and deletion, your request must be verifiable before we can fulfill such request. Verifying your request will require you to provide sufficient information for us to reasonably verify that you are the person about whom we collected personal information or a person authorized to act on your behalf. We will only use the personal information that you have provided in a verifiable request in order to verify your request. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority. Please note, where permitted by applicable data protection laws, we may charge a reasonable fee or refuse to act on a request if such request is excessive, repetitive or manifestly unfounded.

Do Not Track: Our websites and apps are not designed to respond to "do not track" requests from browsers.

“Shine the Light” and “Eraser” Laws: Residents of the State of California may request a list of all third parties to which we have disclosed certain information during the preceding year for those third parties’ direct marketing purposes.

California Consumer Privacy Act (CCPA)/California Privacy Rights Act (CPRA): The CCPA, as amended by the CPRA, provides California residents and/or their authorized agents with specific rights regarding the collection and storage of their personal information.

Your Right to Know: California residents have the right to request that we disclose the following information to you about our collection and use of your personal information over the past twelve (12) months. We may ask you to provide certain information to identify yourself so that we may compare it with our records in order to verify your request. Upon verification, we will disclose to you:

  1. The categories of personal information we have collected about you.
  2. The categories of sources for the personal information we have collected about you.
  3. The specific pieces of personal information we have collected about you.
  4. Our business or commercial purpose for collecting or selling your personal information.
  5. The categories of third parties to whom we have sold or shared your personal information, if any, and the categories of personal information that we have shared with each third-party recipient.

Your Right to Opt-Out of Sale or Sharing of Personal Information: California residents have the right to opt-out of the sale of their personal information by submitting a request as directed on the homepage of our website or by contacting us using the information in the “Contact Us” section below.

Please note that we do not knowingly sell the personal information of any individuals under the age of 16.

Where we are sharing your personal information with third parties for the purposes of cross-context behavioral advertising or profiling, you may opt-out of such sharing at any time by submitting a request as directed on the homepage of our website or by contacting us using the information in the “Contact Us” section below.

Your Right to Limit Use of Sensitive Personal Information:  California residents have the right to request that we limit our use of any sensitive personal information to those uses which are necessary to perform the Services or for other specifically-enumerated business purposes under the CCPA, as amended by the CPRA.

Your Right to Delete: California residents have the right to request that we delete any of the personal information collected from you and retained by us, subject to certain exceptions. We may ask you to provide certain information to identify yourself so that we may compare it with our records in order to verify your request. Once your request is verified and we have determined that we are required to delete the requested personal information in accordance with the CCPA, we will delete, and direct our third-party service provides to delete, your personal information from their records. Your request to delete personal information that we have collected may be denied if we conclude it is necessary for us to retain such personal information under one or more of the exceptions listed in the CCPA.

Your Right to Correct:  Under the CCPA, as amended by the CPRA, California residents have the right to request that we correct any inaccurate personal information we maintain about you, taking into account the nature of the personal information and the purposes for which we are processing such personal information. We will use commercially reasonable efforts to correct such inaccurate personal information about you.

Colorado Privacy Act:  Starting on July 1, 2023, residents of Colorado have the following privacy rights.

Your Rights of Access and Data Portability:  Colorado residents have the right to confirm whether we are processing personal information and to access such personal information in a portable, and to the extent technically feasible, readily usable format that allows the Colorado resident to transmit the data to another entity without hindrance. Colorado residents may exercise this right no more than two (2) times per calendar year.

Your Right of Correction:  Colorado residents have the right to correct inaccuracies in their personal information, taking into account the nature of the personal information and the purposes for the processing of such personal information.

Your Right of Deletion: Colorado residents have the right to delete personal information that we have collected.

Right to Opt-Out of the Sale of Personal Data, Targeted Advertising and Profiling:  Colorado residents have the right to opt-out of the processing of personal information concerning you for the purposes of (1) targeted advertising, (2) the sale of personal information; or (3) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.  Please note, we do not engage in the sale of personal information or profiling.

Right to Appeal:  Colorado residents have the right to appeal a refusal to take action on any of the rights outlined here within a reasonable period of time.  Colorado residents may submit an appeal by contacting us at privacy@forwardair.com.

Third-Party Links

We may provide links to other websites or resources provided by third parties. These links are provided for your convenience only. We have no control over the content of those websites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access of the third-party links on the Sites, you do so entirely at your own risk and subject to the terms and conditions of those websites.

 Children

 Our Services are not intended to be used by individuals under the age of 16, and we do not knowingly collect personal information from children under 16. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children to never provide us with personal information. If we become aware that a child under 16 has provided us with personal information, we will take steps to delete such information. If you become aware that a child has provided us with personal information, please contact us at privacy@forwardair.com.

 Changes to this Privacy Policy

 This Privacy Policy is effective as of the date stated at the top of this page. We may change this Privacy Policy from time to time. By accessing and using our Sites and Services after we notify you of such changes to this Privacy Policy, you are deemed to have accepted such changes. Please refer back to this Privacy Policy on a regular basis.

Terms of Use

Please read carefully. Use of the forwardair.com web site constitutes agreement with the policy statements listed below. Violation of any of these policies may result in revocation of system access, and possible criminal or civil prosecution.

Subscriber accounts
Subscriber will be assigned a User Name and password when the account is opened. The Subscriber’s account will be for the Subscriber’s company as a whole and will be managed by a duly authorized company administrator. The Company Administrator and Subscriber users agree to safeguard the Subscriber User name(s) and password(s) from any unauthorized use, and agree that Forward Air will not be held liable for the unauthorized use or misuse of any Subscriber User Name or password.

Access to Password Protected/Secure Areas
Access to and use of password protected and/or secure areas of forwardair.com is restricted to authorized customers only. Unauthorized individuals attempting to access these areas of the forwardair.com system may be subject to prosecution. Except as otherwise provided herein, Subscriber is responsible for the confidentiality and use of Subscriber’s User name and password. Subscriber agrees to notify Forward Air promptly of any loss, theft, or unauthorized use of Subscriber’s User Name and password.

Subscriber Conduct
Subscriber is responsible for the content of Subscriber’s transmissions to the forwardair.com system. Subscriber’s use of the forwardair.com system is subject to all applicable local, state, national and international laws and regulations. Subscriber agrees: (1) to comply with U.S. law regarding the transmission of technical data and (2) Agrees not to use the forwardair.com system for illegal purposes.

The forwardair.com system makes use of the Internet to send and receive data. In the event Subscriber accesses forwardair.com via the Internet, Subscriber agrees to be subject to applicable Internet regulations, policies and procedures.

Subscriber agrees not to enter or transmit to forwardair.com any false, inaccurate, misleading, fraudulent, unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material of any kind. Subscriber agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law. Forward Air will fully cooperate with any law enforcement authority or court order requesting or directing Forward Air to disclose the identity of anyone posting such information or material.

Attempts to gain unauthorized access to forwardair.com are prohibited. Subscriber agrees not to interfere with another customer’s use of forwardair.com through any means, including denial of service, theft of confidential information or other misuse of the forwardair.com system.

Service Conditions
Subscriber understands that the forwardair.com system is currently being offered on a complimentary basis, and that Subscriber uses forwardair.com at its sole discretion. Forward Air shall have no liability for any service interruption, data transmitted or data received. Forward Air shall have no liability for any actions taken, or interpretations made, by Subscriber as a result of receiving or not receiving information from forwardair.com.

Forward Air will not be required to maintain a copy of any data transmitted, received or produced by Subscriber. Subscriber acknowledges that it is solely liable for any loss of any message or data transmitted, received or produced through the use of forwardair.com.

Ownership
It is understood and agreed by Subscriber that all intellectual property rights in the computer programs utilized by Forward Air in relation to the forwardair.com system, and the technology, skill and information relating to the effective use thereof, are either licensed to, or are the property of, Forward Air, and nothing contained herein shall be deemed to convey any title or ownership interest whatsoever therein to the Subscriber.
